Welcome to Art Panels services and website accessible at www.art-panels.co.uk. The Website, and Services is owned and operated by "Art Design Ltd" with Business address: 18 Sandford Gardens, High Wycombe, HP11 1Q. These Terms and Conditions (or "Terms of Use") govern your use of the site, except where we expressly state that separate terms (and not these) apply, and provide information about the www.art-panels.co.uk Service (the "Service"). When you purchase a product or use our services, you agree to these Terms.

2. About us

We are a UK Wall Panel seller, a company registered in England and Wales under company number: 14303369. Our registered office is at: 18 Sandford Gardens, High Wycombe, HP11 1Q. We provide distinct, modern and authentic wall panels, wall mouldings, coving and other home decor products in different sizes and preferences. 3. Individual

Our Services are available only to individuals who can be referred to as Customers or Users 18 years or above of age and can enter into a legally bindin agreement under the United Kingdom laws.

Any reference to ‘we’, ‘us’ or ‘our’ in these terms is to Art Panels and Art Design Ltd, and any reference to ‘you’ or ‘your’ is to the individual placing an order with us.

5. These terms

These terms apply to any purchases you make on our website, via phone, email or over the warehouse. Please read these terms carefully before you place any orders, as they set out important information about your and our rights and obligations. Please note that you must agree to these terms before you place your order.
For the purposes of these terms, you are a ‘Customer’ ‘User’ if you are buying products from us as an individual, so please make sure you read these terms carefully.
You must be at least 18 years old and a resident of the UK to place an order with us. If you are a customer placing an order on behalf of a business, you confirm that you have authority to place such an order for and on behalf of that business.
We may make changes to these terms at any time. However, the terms which apply to your order will be those in force at the time you submitted your order to us.

6. Availability

All orders are subject to availability and confirmation of the order price. Don’t worry, if there’s an issue with your order, we’ll get in touch with you. For example, where there has been a change in production, we may need to stop selling certain products. If this happens and it affects your order, we will notify you by email, cancel your order and provide you with a full refund (including any delivery costs) if payment has already been received from you.

7. Orders

Please check your order carefully and correct any errors before you submit it to us if placing your order via our website. If you are placing your order via phone or email, please ensure that you check any product name spelling, all products are correct and all quantities are accurate.
After you send your request and place your order, we will send you an acknowledgment email to let you know that we have received your request and order. This does not mean that your order has been accepted by us. Your order is an offer to buy products from us on these terms. We reserve the right to cancel your order at any time at our own discretion.
Order considered as “placed” after client’s payment has been cleared.
We will send you a shipping confirmation email to let you know once your order has been dispatched.
If we do not accept your order, for example because we have been unable to pre-authorise the payment, the products are unavailable, you are under 18 or there has been a mistake regarding the pricing or description of the products, we will contact you, using the details you provided when you placed your order. We have the right to reject any order for any reason.
If we are making any bespoke or custom products for you which are based on measurements or other information you provide to us, you are responsible for ensuring that the information is correct and accurate.

8. Lead Time

When you intend to order from us, you will be directed to send us a request on the site, your request will include your order details, such as which product, how many metres, size and other preferences provided by you (Customer).

We will endeavour to process and send your preference for production within 20 business days which is the average lead time after sending in your request. Some custom orders can take longer to produce as it requires extra preparation.

We always aim to stay within this given timeline, however this suggested time-frame is no guarantee due to the uncertainty of circumstances in the current times.

9. Making changes to your order

If you would like to make any changes to your order after you have submitted it, please contact us as soon as possible and we will let you know if it is possible to change your order. Unfortunately, due to the nature of some products, it is not always possible to change an order if the production process has started already.

10. Products Description

A description of a product, or item on this site does not imply endorsement by us, or suitable for you.
You agree that:
  • All measurements are described approximately. The colours and designs displayed on the website are as accurate as the photographic images of everyone's screen settings will reasonably allow.
  • Certain elements are shown for photo-shoot purposes only and those items are not provided in the end retail product - as such there can be a possibility of a variation to the size, length, and style.
  • If you have particular preferences that you would like us to consider when making products for you, please get in touch & we will try our best to accommodate you.
  • Your goods may vary slightly from the image shown on the website and not include any of the pictured accessories, unless stated in the specification of the goods. Whilst goods may be shown assembled, they may require assembly by you.

11. Price

Prices for our products are displayed on our website. All prices are in pounds sterling (£)(GBP) and exclude VAT and delivery charges. For information on delivery options and costs, check the options available to you on the “Shipping” page, if you are not placing your order through our website, we shall be able to give you this information when we send you our acknowledgement email.

Prices for our products and delivery charges may change at any time. Except as set out in these terms, such changes will not affect existing orders.

If there has been an error on our website regarding the pricing of any of our products and this affects your order, we will try to contact you using the contact details you provided when you placed your order. We will give you the option to re-confirm your order at the correct price or to cancel your order. If we are unable to contact you, we will treat the order as cancelled and notify you by email.

12. Order Confirmation

Once you submit a Request Form, we will send you a confirmation email to acknowledge that we have received your request Form and then we will send you an invoice of your total order, payable by you using our accepted payment methods. You agree that an order will only be considered as placed when we receive and confirm your payment. We accept bank transfers or Stripe payment. When we receive your payment, the contract between us ("Contract") is formed and we will process the order details you have given to us to produce your order according to your preference.

13. Order Delivery

We will deliver your order to the address specified by you when placing your order. We work in partnership with major UK courier services.
The average lead time is 20 business days after confirmation of payment. Some custom orders can take longer to produce as it requires extra preparation.
After the 20 Business days Lead Time {Production Time}, 2 - 4 business days to deliver your order.
Large orders delivered on pallets at £150+VAT per pallet in up to 5 business days. (usually 2-4 business days)
Smaller orders can be shipped in the box. Price can vary up to £100+VAT per box. Delivery will take 2-5 business days
Samples will be delivered in 2-5 business days (if in stock)
Please examine the products as soon as reasonably possible after delivery and notify us of any fault or damage as soon as reasonably possible and in any event within 24 hours of receipt of the product.
Once your order has been delivered to your address or in accordance with the delivery instructions you provided to us, the risk in the products passes to you and the goods are classed as having been ‘delivered’. This means that you are responsible for the products and we are not liable to you if the products are stolen or damaged after they have been delivered to you. This does not affect your legal rights if the products are faulty or misdescribed.

14. Replacement of Damaged item

All orders are carefully checked prior to dispatch. However, unfortunately, items can sometimes get lost or damaged in transit due to factors beyond our control. If an item arrives damaged in any way please contact us within 24 hours of receipt. We will provide a replacement. You can contact us via email, phone or mail to follow up this process.

If an exchange is necessary, this will be arranged without unreasonable delay and without charge. Replacement goods will not be dispatched until the original goods have been received at our warehouse and checked. The cost of returning goods to us is your responsibility. If the goods are not faulty, we will return them to you, however you will be required to cover our reasonable postage costs.

15. Refunds Concerns

Please note that we do not offer a refund or exchange on orders that have no defects, or damage caused by the Customer after delivering. In the unlikely event where the product was delivered damaged or broken, or does not match your order requirements, we will take responsibility, provide replacement according to our exchange policy and fix such issues to the best of our ability. 16. Copyright Policy

The Website contains valuable trademarks and service marks owned and operated by Art Design Ltd Copyright(c) 2023(s). We are firmly against anyone who is infringing upon another individual Copyright material. We have created this website and materials in accordance with the United Kingdom Copyright law.

If you believe that any content or other material made available on the site, infringes upon any copyright that you own or control, you may notify us in writing via info@art-panels.co.uk

17. Intellectual Property Rights

All content available on the website, including, but not limited to, the trademarks, logos, and service marks displayed on the website (collectively, the "Trademarks") are the registered and unregistered marks of Art Design Ltd, our affiliates, or licensors in The United Kingdom. and other countries. All Trademarks not owned by us, our affiliates, that appear on the website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by us. Except as required under applicable law, neither the services, the Trademarks, nor any other portion of the website may be used, reproduced, duplicated, copied, sold, resold, accessed, modified, or otherwise exploited, in full or in part, for any purpose without our prior written consent.

18. Termination

We reserve the right to immediately suspend or terminate the order of any Customer without warning and notice for violation or breach of any of the agreement in this Terms and Conditions.

19. Governing Law

These terms and the relationship between you and Art Design Ltd is governed by the laws of England and Wales.

You irrevocably agree that the laws of England and Wales, shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Agreement or its subject matter or formation (including non-contractual disputes or claims). The Customer agrees that all claims or disputes shall be subjected to the exclusive jurisdiction of the Courts of England, and Wales.

20. Your feedback

We encourage you to share your reviews and feedback with us, and we promise to respect your feedback irrespective of the outcome, for it helps us improve on our services and make us serve you better. By submitting feedback, you are granting us an irrevocable, perpetual, non-exclusive, transferable, fully-paid, worldwide licence (with the right to sublicense freely) to use, copy, modify, publicly perform, publicly display, reformat, translate, syndicate, republish, excerpt (in whole or in part) and distribute feedback we receive from you for any purpose, including business, commercial, marketing, advertising, or otherwise.

21. Electronic Communications

For the performance of the services, you (a) consent to receive communications from us in an electronic form via the email address you have submitted; and (b) agree that all terms and condition, agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications would satisfy if it were in writing. You retain the right to opt-out of receiving Electronic Communication from us; however, opting out may prevent you from receiving messages regarding our services or special offers, by sending us a Opt-out message via our support email info@art-panels.co.uk
